San Diego Food Markets, LLC
Customer IG Reel Contest

1. THE PROMOTER
The promoter is San Diego Food Markets, LLC of 6549 Mission Gorge Rd. STE 303, San Diego, CA 92120-2306, United States of America, referred to herein as the “Promoter” or “SDFM”.
2. THE CONTEST
a.
The title of the Contest is "Customer IG Reel Contest", referred to herein as the “Contest”.
b.
The Contest begins on December 7, 2024, at 10:00 am PST and ends on March 31, 2025, at 23:59 PST (the "Contest Period"). Throughout this period, participants can submit entries on a weekly basis. The Promoter is not responsible for late, incomplete, misdirected, or delayed entries, including entries not timely received due to internet failures or disruptions, or internet service provider problems. Incomplete information, regardless of cause, may result in the disqualification of an entry.
c.
Each week, one (1) winner will be chosen from those who submitted entries to the Contest during the previous week (the “Submission Period”), based on the eligibility criteria listed in section 4. below.
d.
The Promoter reserves the right to change the Contest Period or change the Submission Period.
3. HOW TO ENTER
a.
To enter the Contest, participants must visit the Lane Field Park Market during operating hours. Create and post an Instagram Reel (“IG Reel”) of yourself enjoying the market, featuring market food and/or products. Include a review or description of your experience in the video.
b.
Use the hashtag #LaneFieldParkMarket and tag @sandiegofoodmarkets in your post.
c.
Ensure that your Instagram account is set to “public” for the duration of the contest.
d.
The IG Reel audio must be in the English language or contain an English translation using captions.
e.
No purchase, payment, or consideration is necessary to enter the Contest.
4. ELIGIBILITY
a.
Participants must be at least 18 years old.
b.
The IG Reel must be original content created by the participant.
c.
Posts must comply with Instagram’s community guidelines.
d.
The IG reel content must showcase the market atmosphere, food, or products in a positive and respectful manner.
e.
Inappropriate, offensive, or irrelevant submissions will be disqualified.
f.
The following persons are not eligible for the contest:
-
employees of the Promoter;
-
employees of vendors, agents, or suppliers of the Promoter, who are professionally connected with the Market, the Contest or its administration;
-
members of the immediate families or households of (a) and (b) above; or
-
users who are subject to any economic sanctions or trade restrictions imposed by the United States or any other applicable jurisdiction.
g.
By entering the contest, you confirm that you are eligible to do so and eligible to claim any Prize you may be awarded. The Promoter may require you to provide proof that you are eligible to enter the Contest.
h.
The Promoter will not accept Contest entries that:
-
use a false name or Instagram account;
-
are automatically generated by a computer or software;
-
are completed by third parties or in bulk;
-
are illegible, have been altered, reconstructed, forged or tampered with;
-
are of poor resolution or incomplete;
-
are created on behalf of another person.
i.
The Promoter reserves the right to disqualify participants if:
-
There is any reason to believe the Participant has violated these Contest Terms and Conditions;
-
multiple Instagram accounts are used to enter the Contest ;
-
are completed by third parties or in bulk;
j.
By entering the Contest, the Participant agrees that any content submitted and/or published in the scope of the Contest may not:
-
contain any material that is defamatory, obscene, profane, or offensive;
-
contain any false, unsubstantiated, or unwarranted claims for any product or service;
-
contain any false or misleading statement or representation, including, but not limited to providing a false name or Instagram account;
-
advertise any habit-forming drug, tobacco product, weapon, firearm, or ammunition;
-
violate the rights of any person, entity, firm, or corporation, including intellectual property rights and any copyright;
-
violate the rights of any person, entity, firm, corporation, or any other third party, including intellectual property rights and any copyright;
-
disparage or libel any vendor’s products, or;
-
depict the consumption of alcoholic beverages in violation of applicable law.
-
Breach of the above will result in disqualification.
k.
Promoter reserves the right to exclude a participant who violates these Contest Terms and Conditions. If a participant is disqualified, prizes may be withheld. In this case, the Promoter may select a new alternative Winner, subject to the Promoter’s sole discretion, based on the same Judging Criteria.
5. THE PRIZE
a.
The Winner(s) will be awarded with the following prize, referred to herein as the “Prize”:

US $25 Lane Field Park Market Voucher.
b.
The market voucher may be used to purchase food, crafts, fashion, jewelry, or other products offered for sale by the vendors at Lane Field Park Market.
c.
The market voucher will be delivered electrically.
d.
The Prize is non-transferable and cannot be exchanged for cash.
e.
The market voucher will expire on the date listed on the voucher.
f.
All taxes, duties, fees, or other expenses associated with the Prize are the sole responsibility of the Winner(s).
g.
To receive the Prize, each participant agrees to provide any documents and/or information required by the Promoter, including completing, signing, and returning an affidavit of eligibility and liability/publicity release, if requested.
6. WINNER SELECTION AND NOTIFICATION
a.
The Promoter will review the IG Reel entries and choose one (1) winner among eligible participants. If no entry satisfies the eligibility criteria, no winner will be selected.
b.
Entries will be judged based on creativity, originality, and engagement (likes, comments, etc.).
c.
The decision of the Promoter is final and no correspondence or discussion will be entered into.
d.
The Winner(s) will be notified via their Instagram account. Additionally, the Promoter may announce the Winner(s) on its social media channels. Participants who do not become winners will not receive any notice stating so.
e.
The Prize may not be claimed by a third party on the Winner’s behalf.
f.
The Promoter does not accept any responsibility if the Winner(s) fail to exercise the Prize by the expiration date.
7. PUBLICITY AND INTELLECTUAL PROPERTY RIGHTS
By accepting a Prize in the Contest, each Winner grants to the Promoter:
a.
a non-exclusive, perpetual, worldwide, unlimited, irrevocable license, of any intellectual property rights in the IG Reel video, including any other content uploaded by the Winner, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license the content for marketing purposes; and;
b.
the right to repost, share, and use their submitted content for promotional purposes without prior notification, review, or approval and without payment or consideration.
c.
the right to use and publish (worldwide, via the Internet, and otherwise) his/her name, portrait, image, picture, voice, likeness, and comments for advertising, trade, and promotional purposes without prior notification, review, or approval and without payment or consideration.
8. LIMITATION OF LIABILITY
IN NO EVENT WILL SAN DIEGO FOOD MARKETS, LLC (dba, LANE FIELD PARK MARKETS) BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF: (1) PARTICIPANT’S PARTICIPATION IN THE CONTEST, (2) THE NATURE OR QUALITY OF ANY PRIZES AWARDED, (3) PARTICIPANT’S ACCESS TO OR USE OF SAN DIEGO FOOD MARKETS, LLC’S SOCIAL MEDIA CHANNELS, WEB SITES OR THIRD-PARTY APPLICATIONS, (4) THE ACCESSING, DOWNLOADING AND/OR PRINTING OF ANY MATERIAL AVAILABLE ON SAID SITE; OR (5) THE EXERCISE OF THE PRIZES. WITHOUT LIMITING THE FOREGOING, EVERYTHING OFFERED ON IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES OR EXCLUSIONS OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
PARTICIPANTS FURTHER ACKNOWLEDGE AND AGREE THAT SAN DIEGO FOOD MARKETS, LLC HAS NO RESPONSIBILITY OR LIABILITY WITH RESPECT TO THE INSTAGRAM SOCIAL MEDIA PLATFORM. THIS INCLUDES, BUT NOT LIMITED TO, THEIR AVAILABILITY, TERMS, QUALITY, OR FULFILLMENT, AS THESE ARE GOVERNED BY INSTAGRAM’S TERMS. SAN DIEGO FOOD MARKETS, LLC SHOULD NOT BE HELD ACCOUNTABLE FOR ANY OF THE TERMS REQUIRED TO USE INSTAGRAM’S SOCIAL MEDIA PLATFORM.
9. INSTAGRAM DISCLAIMER
This contest is in no way sponsored, endorsed, administered by, or associated with Instagram.
10. GOVERNING LAW
This contest is governed by the laws of the state of California, United States of America.
11. GENERAL
By participating in the Contest, each participant acknowledges they have read, understand, and will abide by these Terms and Conditions.

If, for any reason, the Contest is not capable of running as planned because of circumstances including unauthorized intervention, fraud, technical failures, or any other causes, which, in the Promoter’s sole discretion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Promoter reserves the right to cancel, terminate, modify or suspend the Contest and to select Winners, if any are selected, from participants received prior to the occurrence of such cause.
